License Terms (EULA)

These License Terms ("License") govern your use of the LocalPhotos application ("the Software"). By purchasing, downloading, or using the Software, you agree to this License. Please read it before you buy. If the Software is obtained through the Mac App Store, Apple's Licensed Application End User License Agreement also applies; where Apple's terms and these terms differ, the term that is more specific to the issue controls, and Apple's mandatory terms prevail to the extent required.

1. License grant

Your one-time payment grants you a non-exclusive, non-transferable, perpetual license to install and use the version of the Software available at the time of your purchase, for your personal use, subject to this License.

2. What "lifetime" and "perpetual" mean

"Lifetime," "perpetual," and "forever" refer to a one-time payment with no recurring subscription and your right to keep using the version you purchased. They do not refer to the lifetime of any person, and they do not guarantee that the Software, any particular feature, or any optional component will operate indefinitely.

3. As-is; no promise of upgrades or updates

The Software is licensed as-is, for its functionality as it exists at the time of purchase. You are purchasing the current version only. The Licensor does not promise, and you are not paying for, any future updates, upgrades, new features, bug fixes, or compatibility with future versions of macOS, future hardware, or future file formats. If any update is made available, it is provided at the Licensor's sole discretion and creates no obligation to provide any further update.

4. Discontinuation

The Licensor may modify, discontinue, or stop supporting the Software or any of its features at any time. A version you have already purchased will continue to function as designed on a compatible system.

5. Your data and backups

The Software can move files to the Trash, merge or remove duplicate files, mark items for deletion, and modify your library metadata. You are solely responsible for keeping current backups of your photos and data. To the maximum extent permitted by law, the Licensor is not liable for any loss, deletion, or corruption of files or data, however caused.

6. No warranty

To the maximum extent permitted by law, the Software is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Statements about performance (for example, "fast," "instant," or "in seconds") describe typical results and will vary depending on your hardware, storage, and library size.

7. Limitation of liability

To the maximum extent permitted by law, the Licensor's total liability for any claim arising out of or relating to the Software will not exceed the amount you actually paid for it, and the Licensor will not be liable for any indirect, incidental, special, or consequential damages, including loss of data or loss of profits.

8. Refunds

Purchases made through the Mac App Store are subject to Apple's refund policy, and the Licensor cannot issue App Store refunds. The free trial is provided so that you can evaluate the full Software before deciding to purchase. See our Refund Policy.

9. Your statutory rights as a consumer

Nothing in this License excludes or limits any rights you have under mandatory consumer-protection laws in your country that cannot legally be waived — including, where applicable, your right to receive updates that are necessary to keep digital content in conformity for a reasonable period. Where such laws apply, those rights prevail over Sections 3, 6, and 7 to the extent of any conflict.

10. Acceptable use

You agree not to reverse engineer, decompile, resell, redistribute, or sublicense the Software except to the extent this restriction is prohibited by applicable law or permitted by the store through which you obtained it.

11. Governing law

This License is governed by the laws of [Governing jurisdiction — e.g., your country/state], without regard to its conflict-of-laws rules, except where mandatory local consumer law applies to you.
